Proposed Legislation to modify The Abigial Taylor Pool Safety Act Authored by Representative Larry Howes (R) District: 04B
Last week a new piece of legislation was proposed by Representative Larry Howes (R) District: 04B which we believe underminds the integrity and effectiveness of the Abigail Taylor Pool Safety Act. We are working with the CPSC, the MDH and representatives from both the House and the Senate to discuss and understand the ramifications. You can see the changes he is proposing.

1.1A bill for an act
1.2relating to health; modifying the definition of public pool;amending Minnesota
1.3Statutes 2008, section 144.1222, subdivision 4.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.5 Section 1. Minnesota Statutes 2008, section 144.1222, subdivision 4, is amended to
1.6read:
1.7 Subd. 4. Definitions. (a) For purposes of this section, the following terms have
1.8the meanings given them.
1.9 (b) "ASME/ANSI standard" means a safety standard accredited by the American
1.10National Standards Institute and published by the American Society of Mechanical
1.11Engineers.
1.12 (c) "ASTM standard" means a safety standard issued by ASTM International,
1.13formerly known as the American Society for Testing and Materials.
1.14 (d) "Public pool" means any pool other than a private residential pool, that is: (1)
1.15open to the public generally, whether for a fee or free of charge; (2) open exclusively to
1.16members of an organization and their guests; (3) open to residents of a multiunit apartment
1.17building, or apartment complex, residential real estate development, or other multifamily
1.18residential area; (4) open to patrons of a hotel or lodging or other public accommodation
1.19facility; or (5) operated by a person in a park, school, licensed child care facility, group
1.20home, motel, camp, resort, club, condominium, manufactured home park, or political
1.21subdivision with the exception of swimming pools at family day care homes licensed
1.22under section 245A.14, subdivision 11, paragraph (a). A swimming pool operated by a
1.23common interest community, under section 515B.1-103, clause (10), that is open to its
2.1residents and their guests, but is not open to the public generally, is not a "public pool" for
2.2purposes of this section and sections 157.16 and 157.20.
2.3 (e) "Unblockable suction outlet or drain" means a drain of any size and shape that a
2.4human body cannot sufficiently block to create a suction entrapment hazard and meets
2.5ASME/ANSI standards.
